Wacks Membresie Terms

/ WEBSITE OWNER

The owner of the website https://wacks.xyz/ (hereinafter, the “Website”) is WACKSREALGOODS, S.L., with registered office at Paseo de la Castellana 194 - Bajo B, 28046 Madrid (Spain), duly registered in the Madrid Commercial Registry, Section 8, Sheet M-832849 and VAT number B75339820. Hereinafter referred to as “WACKS”.

/ PURPOSE OF WACKS MEMBRESIE

The membership (hereinafter, “Wacks Membresie” or “Membresie”) allows you, once successfully subscribed, to access WACKS launches, drops or collections during the validity of your subscription 24 hours before the official public release date and time on the Website, in accordance with these conditions, as well as additional benefits that WACKS may decide to offer at any given time.

Early access does not guarantee stock availability. Products may sell out during the presale period.

WACKS reserves the right to limit the number of garments you may purchase during the presale.

Membresie does not include physical products by itself; purchases and orders remain subject to the purchase conditions.

By accepting these conditions, you declare that you are of legal age and have sufficient legal capacity to be bound by these terms, having previously read and understood their content.

Membresie is offered exclusively to end consumers. WACKS may refuse registration or cancel the subscription if fraud, abusive use, systematic resale or breach of these Conditions is detected.

/ SUBSCRIPTION PROCESS

The steps required to subscribe to Membresie are described in these conditions, as well as those specifically indicated on your device screen during the subscription process.

To subscribe, you must add the monthly Wacks Membresie subscription to your cart and proceed with payment by providing the requested information on the checkout page (email address, card details, billing address and phone number).

Once the monthly payment has been successfully completed, WACKS will confirm your subscription by email.

Currently, the subscription process is only available in Spanish.

WACKS will not store a copy of these conditions linked to each subscription, therefore we recommend saving a personal copy. In any case, you may download the conditions in PDF format through the link above.

The Website does not provide technical means to identify and correct errors in data entry, except for detecting incomplete mandatory fields required to process the subscription.

/ PAYMENT METHODS

Credit / Debit Card

Only Visa, MasterCard and American Express cards are accepted.

Card charges are processed in real time through the virtual POS once the card details (card number, expiration date and CVV) have been verified.

WACKS does not store any credit or debit card information.

Your card details are encrypted through SSL certification exclusively for payment processing purposes.

Cards are subject to authorization and verification by the issuing bank. If payment is not authorized, the subscription contract cannot be considered completed.

By selecting this payment method, you guarantee that you are fully authorized to use the card during the purchase process.

Google Pay

Google Pay is accepted provided your device and browser are compatible and properly configured.

Apple Pay

Apple Pay is available for compatible Apple devices, provided the service has been previously configured on your device.

/ PRICE & RENEWAL

Price

The price of Membresie is 8 EUROS per month, taxes included (€8.00/month), charged through the payment method selected during the subscription process.

The price and applicable taxes will always be displayed clearly before completing the subscription.

Monthly Subscription, Renewal & Cancellation

Membresie is a monthly subscription and renews automatically every month, charging the selected payment method unless cancelled before the renewal date.

If payment cannot be processed, WACKS may temporarily suspend access to Membresie until payment is successfully completed.

You may cancel automatic renewal at any time by contacting WACKS by email or through the channels indicated by WACKS. Cancellation will take effect at the end of the already-paid monthly period, maintaining access until that date unless otherwise required by applicable law.

/ RIGHT OF WITHDRAWAL

Withdrawal Period

You have the right to withdraw from the Wacks Membresie subscription without justification within 14 calendar days from the subscription confirmation date.

Exception to the Right of Withdrawal

Without prejudice to the above and in accordance with Article 103(a) of Royal Legislative Decree 1/2007 of November 16, the right of withdrawal shall not apply to service contracts once the service has been fully executed, where execution began with the consumer’s prior express consent and acknowledgment that the right of withdrawal would be lost once the contract had been fully performed.

Therefore, you expressly acknowledge that you will lose your right of withdrawal if, after subscribing to Membresie, you access a presale, regardless of whether you ultimately purchase a product or not.

To exercise the right of withdrawal, you must notify your decision through an unequivocal statement sent by email to: info@wacks.xyz

WACKS will confirm receipt of your withdrawal request by email without undue delay.

Consequences of Withdrawal

If the withdrawal exception does not apply, WACKS will reimburse the monthly subscription fee without undue delay and no later than 14 calendar days from the date you informed WACKS of your withdrawal decision.

The refund will be processed using the same payment method used for the original transaction unless expressly agreed otherwise.

/ CLAIMS

In the event of any lack of conformity attributable to WACKS, you must inform WACKS through: info@wacks.xyz

WACKS will contact you as soon as possible to address the issue and, where appropriate, proceed with the corresponding refund.

Even without the official form, you may submit a complaint in any format before any competent municipal or regional authority.

/ PERMITTED USE, LIMITATIONS & ANTI-FRAUD MEASURES

Membresie and early access are personal and non-transferable. Sharing access links/codes or allowing third-party use is prohibited.

The use of bots, automations or any practice intended to bypass purchasing controls, unit limits or security measures is strictly prohibited.

WACKS may suspend or cancel Membresie and/or restrict purchases associated with the account where there are reasonable indications of fraud, abuse, systematic resale or breach of these conditions.

/ DATA PROTECTION

WACKS is responsible for processing your personal data in order to manage your Membresie subscription and send operational communications related to launches, drops or collections.

You may exercise your rights of access, rectification, deletion, objection, portability and restriction of processing by sending an email to: info@wacks.xyz

If you believe the processing does not comply with applicable regulations, you may file a complaint with the supervisory authority at: www.aepd.es

/ GOVERNING LAW & JURISDICTION

These Membresie subscription conditions are governed by Spanish law. However, this choice of law does not prevent you from benefiting from mandatory protections granted by the laws of your habitual residence if you qualify as a consumer.

The courts corresponding to your place of residence shall have jurisdiction over any dispute, provided you qualify as a consumer or user.
